Family intends to sue State

THE family of a man who died last year while in the custody and care of the Transformed Life Ministry Rehabilitation Centre in ­Arouca have indicated their intention to file legal ­action against the State for negligence, after it authorised and approved the institution as a suitable place for outpatients from the St Ann’s Psychiatric Hospital.

In addition to that, attorneys for the family said they have received instructions to bring a claim for damages for negligence against the centre for fraudulently representing itself as a rehabilitation centre that could provide a ­reasonable, acceptable and appropriate standard of care for their loved one with a complement of suitably qualified and ­properly trained staff.

In a request for information and pre-action protocol letter issued to the Ministry of Health yesterday, copied to the Solicitor General, ­attorneys Anand Ramlogan, SC, and Ganesh Saroop stated their client was subjected to ­debasing sub-humane conditions of detention, and subjected to cruel and unusual treatment and punishment.
